BELON Terms of Sale & Service

The agreement between you and BELON when you buy from or use belon.com.

These terms are a contract between you and Oyster Products LLC, a New York limited liability company doing business as BELON (“BELON,” “we,” “us”). They apply when you browse belon.com, create an account, or buy something from us. By using the site or placing an order, you agree to them. You must be 18 or older to purchase.

Four companion documents are part of this agreement and are incorporated by reference: the Privacy Policy, the Return & Refund Policy (including the 60-Day Trial), the Shipping Policy, and the BELON Limited Warranty. Where those documents give you something more generous than these terms, the more generous term wins.

Section 12 contains an arbitration agreement and class action waiver that affect your legal rights, along with a 30-day right to opt out of it. Please read it.

1. Our products, described honestly

BELON is a gravity-fed water filter: a stainless steel funnel with a replaceable carbon filter element that filters into the vessel of your choice. Our product pages state what our filters have been tested to reduce, at accredited laboratories under NSF/ANSI protocols, and we publish the full test reports. Where certification is pending, we say so. We do not promise anything beyond what the published tests show.

Two specifics worth repeating in the contract itself: BELON filters do not remove fluoride, and BELON is not a medical device and does not make water safe that is not from a treated municipal supply. Each filter element is rated for 50 gallons with typical municipal cold tap water — roughly six months at one liter a day, roughly three months at two. Filter life varies with your water; sediment-heavy or very hard water shortens it. The instruction manual states the intended operating conditions, and the 60-Day Trial exists for the case where BELON turns out not to suit your water.

2. Orders

Your order is an offer to buy; our contract is formed when we send the shipping confirmation. We may decline or cancel an order before then — for suspected fraud or resale at scale, address problems, inventory errors, or an obvious pricing mistake — and if we do, you get a prompt full refund and an explanation. If a listed price is plainly erroneous, we will contact you with the correct price and cancel at no cost if you'd rather not proceed.

3. Prices, taxes, and payment

Prices are in US dollars and can change, but never for an order already placed. Sales tax is calculated and shown at checkout based on your shipping address. Payment is collected at the time of order through Shopify Payments (all major credit and debit cards), Shop Pay, Apple Pay, Google Pay, or PayPal (including Venmo); card details go to the payment processor, not to us. You represent that you're authorized to use the payment method you provide.

4. Filter subscriptions

Subscriptions exist so you don't have to remember filter changes. The mechanics, stated the way we'd want them stated to us:

  • What renews and what it costs. A subscription ships the filter pack you chose, at the cadence you chose (the default is every six months), at the price shown when you subscribed. If we ever change a subscription price, you get email notice at least 30 days before it affects you.
  • Notice before every charge. We email you before each shipment is billed, with the date, the amount, and one-click links to skip, reschedule, or cancel.
  • Cancel anytime, online, in the same place you signed up. Manage or cancel from your account on belon.com or the link in any subscription email. Cancellation is effective immediately for any shipment that hasn't been billed; if an order has already been billed and shipped, the Returns & Shipping Policy applies to it.

No fees to cancel, no phone calls required, no retention scripts.

5. Shipping, title, and risk

We currently ship within the United States only; timelines and costs are in the Shipping Policy. Title passes to you on payment; risk of loss passes on delivery to your address. If a shipment arrives damaged or goes missing in transit, contact support@belon.com — we replace transit-damaged or lost orders; you will not be left to argue with a carrier.

6. Returns and the 60-Day Trial

Your first BELON system order comes with a 60-day trial: use it with your own water, and return it for a full refund within 60 days of delivery if it isn't for you — whatever the reason, including your water. Details, and the rules for replacement filters, are in the Return & Refund Policy.

7. Warranty

Products are covered by the BELON Limited Warranty — two years on the system, and coverage of the filter element against defects through its rated life. Except for that written warranty and anything the law does not let us modify, we make no other express warranties. Any implied warranties (including merchantability and fitness for a particular purpose) are limited in duration to the term of the written warranty, to the extent the law allows. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

8. Your account and acceptable use

Keep your account credentials to yourself; you're responsible for activity under your login, and we'll help if you think it's been compromised. Don't use belon.com to break the law, probe or disrupt the site, scrape at scale, misrepresent who you are, or place fraudulent orders. We can suspend accounts and refuse service where that happens.

9. Reviews, photos, and other content you share

If you post a review or share photos or comments with us (including by tagging us on social media where the platform's terms allow sharing), you give BELON a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with BELON's products and marketing, crediting you where practical. That license lasts while your content is in use — it is not a perpetual grab: email support@belon.com asking us to stop using something and we will retire it from active use within a reasonable time (past printed materials excepted). You promise the content is yours and doesn't violate anyone else's rights. We don't pay for reviews and we don't edit them into saying something you didn't.

10. Our intellectual property

The BELON name and logo, the site, its text, images, 3D models, and design are ours (or licensed to us) and protected by trademark, copyright, and patent law, including issued and pending US patents. Buying a BELON gives you the product, not a license to manufacture it, imitate it, or use our marks.

11. Disclaimers and limits on liability

The website itself (as distinct from the products) is provided as-is; we work to keep it accurate and available but don't guarantee it will be error-free or uninterrupted.

To the maximum extent permitted by law, BELON is not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of these terms or any order is limited to the amount you paid us for the product or service giving rise to the claim.

That limitation does not apply to: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) our indemnification-free obligations under the Limited Warranty; or (d) any liability the law does not allow us to limit. Nothing in these terms takes away rights that consumer protection law gives you and doesn't let you waive.

12. Disputes: talk first, then individual arbitration — with an opt-out

Step one, always: email support@belon.com with your name, order number, and what went wrong. We commit to a substantive reply within 30 days, and in our experience this resolves nearly everything. Neither of us may start arbitration or litigation until this 30-day informal window has run.

Arbitration. If we can't resolve it, you and BELON agree that any dispute arising out of these terms, the site, or a purchase (except the carve-outs below) will be resolved by binding individual arbitration administered by JAMS in New York, New York under its Streamlined Rules and its Consumer Arbitration Minimum Standards, before a single arbitrator. Your filing fee is capped under those standards (currently $250); BELON pays all other JAMS fees. The arbitrator can award whatever a court could award to you individually. Judgment on the award may be entered in any court with jurisdiction.

Carve-outs. Either of us may bring an individual claim in small claims court instead, and either of us may seek injunctive relief in court for intellectual property misuse. Disputes about the Limited Warranty may be brought in court — we do not require arbitration of written-warranty claims.

Your right to opt out. You can reject this arbitration agreement entirely, with no effect on anything else you get from BELON: email support@belon.com with your name and order number, subject line “Arbitration opt-out,” within 30 days of your first purchase. If you opt out, disputes go to court under Section 13.

Class waiver: you and BELON each agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding, and each of us waives the right to a jury trial. If the class waiver is found unenforceable as to a particular claim, that claim proceeds in court, not arbitration.

13. Governing law and venue

These terms are governed by New York law, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration (including if you opt out) belongs exclusively to the state or federal courts located in New York County, New York, and both of us consent to their jurisdiction — except that nothing in this section limits your right to bring a claim in small claims court where you live, or displaces consumer protections of the state where you reside that apply to you regardless of a choice-of-law clause.

14. Notice to California residents

Under California Civil Code § 1789.3, California users are entitled to know that complaints may be filed with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at (800) 952-5210.

15. Changes to these terms

When we change these terms we will update the date and change log, and for material changes — anything affecting price, subscriptions, returns, warranty, or dispute resolution — we will email customers and subscribers before the change takes effect. Changes never apply retroactively to an order already placed, and a material change to the arbitration section restarts your 30-day opt-out window.

16. The boring but necessary

If part of these terms is held unenforceable, the rest stands. Our not enforcing something once isn't a waiver. You may not assign this agreement; we may assign it in connection with a sale of the business, with notice to you. Events beyond either party's reasonable control excuse the resulting delay. These terms plus the incorporated documents are the entire agreement between us about belon.com and your purchases.
